1. Acceptance of Terms

By engaging Pestenders for pest control services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you ("Customer" or "you") and Pestenders ("Company," "we," or "us").

2. Service Description

Pestenders provides professional pest control services including but not limited to:

  • Pest inspection and identification
  • Treatment and extermination services
  • Preventive pest control measures
  • Follow-up services and monitoring
  • Emergency pest control services

2.1 Service Limitations

Our services are designed to control and reduce pest populations. While we strive for complete elimination, we cannot guarantee that all pests will be permanently eliminated due to factors beyond our control, including but not limited to environmental conditions, building structure, and customer maintenance practices.

3. Service Agreements and Scheduling

3.1 Appointments

All service appointments must be scheduled in advance. We offer Immediate service when available. Customers must provide accurate contact information and property access details.

3.2 Access Requirements

Customer must provide reasonable access to the property for inspection and treatment. If access is denied or restricted, additional fees may apply for return visits.

3.3 Cancellation Policy

Customers may cancel or reschedule appointments with at least 24 hours notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee.

4. Pricing and Payment

4.1 Service Fees

All pricing is provided in writing before service begins. Prices may vary based on property size, pest type, severity of infestation, and treatment method required.

4.2 Payment Terms

Payment is due upon completion of service unless other arrangements have been made in writing. We accept cash, check, and major credit cards. A service fee may apply to returned checks.

4.3 Additional Services

Any additional services requested beyond the original scope of work will be quoted separately and require customer approval before proceeding.

5. Warranties and Guarantees

5.1 Service Guarantee

We provide a satisfaction guarantee on our services. If pests return within the warranty period specified in your service agreement, we will return to re-treat the affected areas at no additional charge.

5.2 Warranty Limitations

Our warranty is void if:

  • Customer fails to follow post-treatment instructions
  • Property conditions change significantly
  • Customer uses other pest control services or products
  • New pest infestations are introduced from external sources

6. Customer Responsibilities

Customers agree to:

  • Provide accurate information about pest problems and property conditions
  • Follow all pre-treatment and post-treatment instructions
  • Remove or cover food, dishes, and personal items as directed
  • Ensure pets and family members follow safety guidelines
  • Maintain reasonable sanitation and property maintenance
  • Report any adverse reactions or concerns immediately

7. Safety and Liability

7.1 Safety Precautions

All treatments are performed using EPA-approved products and methods. Customers will be provided with safety instructions and must comply with all guidelines provided by our technicians.

7.2 Limitation of Liability

Pestenders' liability is limited to the cost of services provided. We are not liable for indirect, consequential, or incidental damages. Our maximum liability shall not exceed the total amount paid for services.

7.3 Insurance

Pestenders maintains general liability insurance and workers' compensation coverage. Proof of insurance is available upon request.

8. Environmental and Health Considerations

We are committed to using environmentally responsible pest control methods. All chemicals and treatments used comply with federal and state regulations. Customers with specific health concerns or allergies should inform us before treatment begins.

9. Intellectual Property

All materials, methods, and proprietary information used by Pestenders remain our intellectual property. Customers may not reproduce, distribute, or use our methods without written permission.

10. Privacy and Data Protection

We respect customer privacy and handle all personal information in accordance with our Privacy Policy. Customer data is used solely for service delivery and business operations.

11. Dispute Resolution

11.1 Initial Resolution

Any disputes should first be addressed directly with our customer service team. We are committed to resolving issues promptly and fairly.

11.2 Arbitration

If direct resolution is not possible, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Governing Law

These terms are governed by the laws of the State of Texas. Any legal proceedings will be conducted in the appropriate courts of Pleasanton California.

13. Modifications and Updates

Pestenders reserves the right to modify these terms at any time. Updated terms will be posted on our website and customers will be notified of significant changes. Continued use of our services constitutes acceptance of modified terms.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
